Home Solutions Policy
I am delighted to welcome you as a Home Solutions
customer. As one of Europe’s largest insurance companies, Zurich prides
itself on the fact that our size, whilst providing you with the highest
level of financial security, does not prevent us from showing a human
face and an understanding of your needs, particularly if you should ever
need to make a claim.
I would strongly recommend that you read your policy to ensure that it
provides the cover you require. If you are unsure on any aspect, please
contact your insurance adviser or alternatively you can contact us.
If you decide that this insurance does not meet your needs, please return
it to us or your insurance adviser within 14 days of receipt and, provided
there have been no claims, we will refund the premium in full.
As your insurer we will endeavour to respect the trust you have placed
in us but, should you at any time be dissatisfied with our service, a
complaints procedure is provided below. This includes full details of
our participation in the Insurance Ombudsman scheme, of which we are founder
members.

Home Solutions Policy
We will provide insurance against loss,
damage or injury which may occur during the Period of Insurance in accordance
with the Sections specified in the Schedule subject to the exclusions, conditions
and endorsements of the Policy.
We have discretion following a claim to make payment in money or effect
necessary repair, replacement or reinstatement.
The Policy, Schedule and Specifications shall be read together as one contract.
Please read the Policy, Schedule and any Specifications to ensure that they
have been prepared in accordance with the cover you have selected. If they
are not correct, or do not meet your wishes, please return them immediately.
Definitions
The definitions shown alongside
the following words or expressions will apply wherever they appear in the
Schedule, Specifications or Endorsements. They also apply wherever they
appear in the Policy other than Section 6 for which separate definitions
apply . Additional definitions apply to Section 7.

or, in the case of warm air, ductwork and heat emitters, together
with any multipoint or circulator water heater providing domestic

Buildings- the sum
insured stated in the Schedule will be adjusted monthly in line with
the House Rebuilding Cost Index produced by the Royal Institution
of Chartered Surveyors.
At each renewal the premium will be calculated on the adjusted sum
insured.
In the event of a claim the sum insured will continue to be
adjusted during the period necessary to repair the buildings
provided repairs are carried out as soon as reasonably possible.
Note: All adjustments referred to in this definition will be
upwards only. The sums insured will not be reduced unless you advise
us to do so in writing. |

Section 1 – Buildings
The sum insured stated in the Schedule
is index linked and will not be reduced by the amount of any claim
payment.
Basis of Claims
Settlement
We will pay the cost incurred in
repairing, replacing or reinstating the buildings subject to the
following provisos:
A deduction for wear and tear will be made if:
the sum insured on buildings at the time of the loss or damage is
less than the cost of rebuilding the whole of the buildings in a
new condition similar in form, size and style, or
the buildings have not been maintained in good repair.
We have discretion following a claim to make payment in money
or effect necessary repair, replacement or reinstatement.
The maximum amount payable for each claim under paragraphs 1 to 12
and where applicable paragraph 19 is the Buildings sum insured stated
in the Schedule plus index linked increases less any amount stated
in the Exclusions.
We will not pay the cost of replacing
any undamaged item or part of any item solely because it forms part of a
set, suite or one of a number of items of a similar nature, colour or design.

The buildings
are insured against loss or damage by the following causes:

The first amount
of each claim under paragraphs 1 to 3 and 5 to 12 shown alongside
the word EXCESS in the Schedule.

a. Fire, explosion, lightning or earthquake
b. Smoke

b. Loss
or damage by any gradually operating cause.
|
2.
a. Riot, civil commotion, strikes, labour and political disturbances
b. Wilful or malicious acts

b. Loss or damage:
- by a member of the family
- while the home is unfurnished

3. Storm
or flood

Loss or damage:
- by frost, subsidence, heave or landslip
- to gates, fences and railings
- due to a gradually operating cause.

4. Subsidence or heave of the site on which the buildings stand,
or landslip

The first £1,000 of each claim.
Damage to or resulting from the movement of solid floor slabs unless
the foundations beneath the external walls of the home are
damaged at the same time by the same cause.
Loss or damage:
- caused by the bedding down of new buildings
- caused by or resulting from coastal or river erosion
- to patios, terraces, hard tennis courts, sunken swimming pools,
ornamental ponds, fountains, cesspits, septic tanks, central heating
fuel tanks, paths, drives, walls, gates, fences, railings and
lampposts unless the home is damaged at the same time by
the same cause.

5. Escape of water from fixed tanks, apparatus or pipes and
damage caused to such items by freezing or forcible and violent
bursting
|
Loss or damage
while the home is unfurnished or unoccupied.

6. Escape of oil from fixed domestic tanks, apparatus or pipes

Loss or damage
while the home is unfurnished.
|
7. Theft
or attempted theft

8. Breakage
or collapse of satellite television receiving equipment, television
or radio aerials, aerial fittings or masts

to the equipment itself.

trees or branches

resulting from felling or lopping of trees by you or on your
behalf.

10. Impact

Loss or damage
by:
· storm or flood (see paragraph 3)

Loss or damage caused by or resulting from:
· alteration or renovation of the home
· maintenance or repair of the home (but see paragraph
19, if operative).

11.
Glass and Sanitary Ware
Accidental breakage of fixed glass forming part of the
home including double glazing and fixed sanitary ware in the
home
|
Breakage while the home is unfurnished.
|
12.
Cables and Underground Pipes
a. Accidental damage to drain inspection covers
and cables or underground pipes for which you are responsible
providing services to or from the home.
b. The cost of breaking into and repairing the pipe between
the main sewer and the home following the blockage of the pipe.
|
|
13.
Lock replacement
If the keys to the locks of the external doors of the house, flat
or bungalow are lost or stolen, we will pay the cost of replacement
locks of an identical type operated by those keys up to a maximum
amount of £250 each claim.
The most we will pay under this paragraph and paragraph 25
of Section 4 is £250 in total each claim.

14. Temporary Accommodation
If the home is made uninhabitable following a claim,
which we have accepted, for loss or damage by a cause described
in paragraphs 1 to 10, or where applicable paragraph 19, we
will pay for the period necessary to restore the home to
a habitable condition:
- the rent lost
- up to two years’ ground rent
- the reasonable cost of comparable accommodation for you,
the family and your domestic pets.
The maximum amount payable in aggregate is 20% of the Buildings
sum insured.

15.
Demolition and Site Clearance
Following a claim, which we have accepted, for loss
or damage by a cause described in paragraphs 1 to 10 or where applicable
paragraph 19 we will pay the cost of making the buildings
safe, removal of debris and clearing the site provided our
prior agreement has been obtained.
|
The cost of removal of trees or branches which:
- have not caused any damage to the buildings
- have caused damage only to gates, fences or railings.
|
|
16. Professional Fees
Following a claim, which we have accepted, for loss
or damage by a cause described in paragraphs 1 to 10 or where applicable
paragraph 19 we will pay the following costs necessarily
incurred in the repair or reinstatement of the buildings:
a. architects’, surveyors’ and other professional fees
b. additional costs arising from compliance with government,
European Community, or local authority requirements
|
a. Fees for preparing any claim
b. Costs arising under a notice served by the government, European
Community or local authority prior to the loss or damage.
|
17. Sale
of the Home
In the event of you entering into a contract to sell the home,
the purchaser shall be entitled to the benefit of cover under the
terms of this insurance in respect of loss or damage occurring between
the period of exchange of contracts and completion of the sale of
the home
|
Loss or damage insured under any other policy.
Any amount payable under paragraph 14.
|
|
18. Property Owner’s Liability
We will pay damages and claimants’ costs and expenses for which
you are legally liable in respect of accidents occurring
during the Period of Insurance resulting in bodily injury or illness
to any person or loss or damage to property arising:
- solely from ownership (not occupation) of the buildings
and their land
- under Section 3 of the Defective Premises Act, 1972 or Section
5 of the Defective Premises (Northern Ireland) Order, 1975
in respect of any private house or flat which you previously
owned and occupied.
In addition, the insurance provided in respect of liability arising
by virtue of Section 3 of the Defective Premises Act, 1972 or Section
5 of the Defective Premises (Northern Ireland) Order, 1975
will continue for a period of seven years from the date of cancellation
of this Policy in respect of the buildings insured at the
date of cancellation
The total amount payable in respect of each claim is limited
to £2,000,000
In addition we will pay defence costs and expenses incurred
with our written consent.
In the event of your death, we will indemnify your
legal personal representatives under the terms of this paragraph
in respect of liability incurred by you
|
Liability:
- for bodily injury or illness to any person employed by a member
of the family where injury or illness arises out of and
in the course of such employment
- for bodily injury or illness to a member of the family
- for damage to property belonging to or under the control of
you or a member of the family or a person employed
by a member of the family
- arising from a contract, whether written or not, which imposes
a liability which you or any member of the family
would not otherwise have been unde
- arising out of any business or profession or the use of lifts
or vehicles
- under Section 3 of the Defective Premises Act, 1972 or Section
5 of the Defective Premises (Northern Ireland) Order, 1975
where a more recently effected or current policy covers the liability.

Buildings Gold
This cover only applies when ‘Buildings Gold’
appears in the Schedule.

19. Accidental
damage to the buildings
|
The first amount of each claim shown alongside the word
EXCESS in the Schedule.
Damage caused by or resulting from:
- frost, damp, corrosion, rust, wet or dry rot, fungus, insects,
vermin or woodworm
- wear and tear, or any gradually operating cause
- chewing, scratching, tearing or fouling by pets
- settlement or shrinkag
- structural alteration or renovation
- defective design, defective workmanship or the use of defective
materials
- maintenance or repair work unless personally carried out by
you or a member of the family.
The cost of maintenance and normal redecoration.
Damage caused by a person to whom the home or any part is
lent, let or sub-let.
Damage specifically excluded under paragraphs 1 to 9 and 11 to 17.

Note: No
words used in this paragraph remove or restrict the cover provided by paragraphs
1 to 17.
Section 2 - Gas Boiler and Central Heating Breakdown
To make a claim under this Section,
it is essential that you contact Aon Home Assistance (on 0800 800-607) in
the first instance. Failure to do this will invalidate cover. Full details
of how to make a claim are included in your Zuricare Assistance booklet
which is supplied to you separately. If you do not receive it, please inform
us or your insurance adviser.

Exclusions (see
also General Exclusions and Exclusions which apply to Section 2)
|
|
If the central heating system in the home sustains a breakdown
we will arrange for the fault to be repaired and we will pay:
- the cost of call out charges
- up to three hours’ labour charges
- the cost of parts not exceeding £1,500 in any one Period of
Insurance
- £250 towards the cost of a replacement boiler should the existing
central heating boiler be beyond economical repair
|
A central
heating boiler or central heating system used other than
for domestic purposes.
A central heating boiler which was more than 10 years old when
the insurance under this Section commenced.
An individual gas fire that is not part of the primary heating system.
Gas leaks which have not been reported to the emergency gas services.
|
Note 1: Cover
under this Section is administered by Aon Home Assistance on our behalf.
This will involve the use of pre-vetted sub-contractors to carry out repairs.
These contractors are registered with The Council of Registered Gas Installers
(C.O.R.G.I.).
Note 2 : If you smell gas in your home contact the emergency gas
services (refer to your local telephone directory) before contacting
Aon Home Assistance.
Exclusions which apply to Section 2
- The replacement of the central
heating boiler in the event of spare parts or components not being
readily available from the manufacturer or their approved suppliers.
- We will not repair any fault
to the central heating boiler if the cost of such repair (together
with the cost of all previous repairs within the current Period of Insurance)
exceeds the replacement cost of the boiler.
- Adjustment to time and temperature
controls and automatic time clocks and programmers when a manual override
is available.
- The replacement of decorative parts.
- Any domestic water supply from the
hot water cylinder to and including taps.
- The cold water supply tank, its
feed and outlets.
- Any defect or inadequacy attributable
to the original design of the central heating system.
- The fabric of the building or pipeworks,
ductwork and flue pipework buried in it.
- Any defect caused through malicious
or wilful action, negligence, misuse or third party interference.
- Any defect or damage occasioned by
fire, lightning, explosion, flood, storm, frost, impact or any other
extraneous cause.
- Consequential damage or loss arising
as a result of a defect occurring in the central heating system.
- Any defect or damage occurring from
a failure of the public electricity or water supply.
- Descaling and any work arising from
hard water scale deposits or from damage caused by aggressive water.
- Shower rose, handset, flexible hose
and mixer valve.
Conditions which apply to Section
2
- We will not accept responsibility
for any delay in the provision of spare parts by suppliers.
- We may supply and fit adequate
replacement parts or components which are not the same as the parts
being replaced but are approved by the appliance manufacturer.
Section 3 - Garden Cover
Basis of Claims Settlement
We
will pay the cost incurred in repairing or where lost or damaged beyond
repair the cost of replacement or reinstatement as new.
We have discretion following a claim to make payment in money
or effect necessary repair, replacement or reinstatement.
We will not pay the cost of replacing any undamaged item or part
solely because it forms part of a set, suite or one of a number of items
of a similar nature, species, arrangement, colour or design.
At our discretion, we may replace plants, trees and shrubs by the
nearest equivalent varieties but no guarantee of the availability of equivalent
maturity, height, colour or shape can be provided.
Repair to damaged lawns will necessitate an element of mismatch due to the
difference in grasses and degree of maturity of the lawn.

We will

1. Up to £1,500 each claim for loss or damage to:
- the garden as a result of fire, explosion, lightning, storm,
flood, smoke, wilful or malicious acts or impact
- the garden as a result of theft or attempted theft
- gates, fences and railings at the home caused by storm
or flood
- the garden caused by falling
- trees or branches,
- walls, gates, fences, railings or lampposts,
- items normally fixed to the home
|
The first £50 of each claim.
- Loss or damage
- by birds, animals or insects
- frost
- by flood to lawns.
- Loss or damage whilst the home is unfurnished.
- Loss or damage to gates, fences or railings unless the home
is damaged at the same time by the same cause
- Loss or damage resulting from felling or lopping of trees by
you or on your behalf.

2. Up to
£250 each claim for the cost of the removal of fallen trees
or branches for which you are responsible
|
|
Section 4 – Contents
Basis of Claims Settlement
We
will pay the cost of repair incurred or where the contents are
lost or damaged beyond repair the cost of replacement or reinstatement
as new or if unavailable its nearest equivalent.
A deduction for wear and tear will be made:
- in respect of clothing and household
linen if lost or damaged beyond repair
- where the sum insured on contents
at the time of loss or damage is less than the cost of replacing the
total contents in a new condition (after making an allowance for wear
and tear on articles of clothing and household linen).
We have discretion following
a claim to make payment in money or effect necessary repair, replacement
or reinstatement. Any cash payment will be limited to the cost to us
of an equivalent replacement.
The maximum amount payable for each claim under paragraphs 1 to
10, 13 and 16, and where applicable paragraph 27, of this Section is the
Contents sum insured stated in the Schedule less any amount stated in
the Exclusions. The sum insured stated in the Schedule will not be reduced
by the amount of any claim payment.
We will not pay the cost of replacing any undamaged item or part
of any item solely because it forms part of a set, suite or one of a number
of items of a similar nature, colour or design.
The total amount of valuables and the maximum amount payable in
respect of any one valuable item are restricted to the limits shown
in the schedule.

or radio aerials, aerial fittings or masts

resulting from felling or lopping of trees by you or on your
behalf.

from a cause arising inside the home other than impact by a
vehicle.

In addition you are also insured for:

Contents in the Open
The contents when in the open within the boundaries of the
land belonging to the home are insured against loss or damage
by the causes described in paragraphs 1 to 10 up to a maximum of £1,000
each claim
|
Loss or damage by impact other than impact by a vehicle, train or
animal.
|
|
12. Contents Temporarily Removed
The contents (including contents belonging to
or the responsibility of any student member of the family)
are insured within the British Isles when temporarily removed
from the home up to a maximum of £5,000 any one claim
against loss or damage by:
- the causes described in paragraphs 1, 3 to 6 and 8 to 10
- theft or attempted theft from within:
- any bank or safe deposit or in the course of removal to
or from any bank or safe deposit by you or a member
of the family
- an occupied private house or flat
- any building where you or a member of the family
are employed or engaged in business
- any other building (including a hall of residence)
provided forcible and violent entry or exit is used

Loss or damage to contents:
- removed for sale or exhibition or in a furniture depository
- in the open by storm or flood
- by impact other than impact by a vehicle, train or animal.
Theft of money from any building where you or a
member of the family are employed or engaged in business.

Glass and Mirrors
Mirrors, ceramic hobs, plate glass on furniture, fixed glass in furniture,
when in the home are insured against accidental breakage
|
|
14.
Audio, Visual and Computer Equipment
Television and audio equipment, video equipment, computer equipment
(used solely for domestic purposes) when in the home,
and television aerials and satellite television dish aerials are insured
against accidental damage
|
Mechanical or electrical failure, wear and tear.
Any process of maintenance or repair.
Damage to records, discs, tapes, cassettes or computer software.
|

15. December and Wedding Gifts Increase
The sum insured under Section 4 Contents is automatically increased
by £3,000:
- during the month of December
- for the period of one month
before and one month after the wedding day of you or any
member of the family to insure wedding gifts against loss
or damage by the causes described in paragraphs 1 to 10 when they
are in:
(i) the home
(ii) the building where the wedding
reception is held
(iii) the bride and groom’s marital residence
(iv) transit between any of the locations described in
(i), (ii) and (iii) above

House Removal
The contents while in the course of removal from the home
to any new permanent home within the British Isles are
insured against loss or damage provided the removal is carried out
by professional removal contractors

Loss of money.
Loss or damage to china, glass, earthenware and other items of a brittle
nature unless packed for removal by professional packers.
|
|
17. Tenant’s Liability
We will pay all sums for which you are legally liable
as tenant and not as owner of the home for:
- damage to the buildings
by a cause described in paragraphs 1 to 3 and 5 to 10 of Section
1 Buildings up to 20% of the contents sum insured for any
one claim
- accidental breakage of fixed
glass forming part of the home including double glazing
and fixed sanitary ware in the home
- accidental damage
to drain inspection covers and cables or underground pipes
for which you are responsible providing services to or
from the home
|
- Loss or damage excluded under
any of the causes described in paragraphs 1 to 3 and 5 to 10
of Section 1 Buildings.
- Breakage while the home
is unfurnished.
|
18.
Prams and Wheelchairs
Perambulators or wheelchairs belonging to you or a member of
the family are insured against loss or accidental damage
when in the British Isles, or elsewhere in the world for
a period not exceeding 60 consecutive days in any one Period of Insurance,
up to an amount not exceeding £500 any one perambulator or wheelchair.

Mechanical or electrical failure, wear and tear, depreciation, loss
of use.
Theft of accessories unless stolen with the perambulator or wheelchair.
|
|
19. Food in Freezer or Refrigerator
We will pay up to £1,000 each claim for loss or damage to
food in the domestic freezer or refrigerator in the home
arising from:
- a rise or fall in temperature
- contamination by refrigerant or refrigerant fumes.
|
Loss or damage caused by the deliberate act of the supply authority
or as a result of any strike or withdrawal of labour.
|
20.
Jury Service
We will pay you or a member of the family an
amount not exceeding £50 per day, for a period not exceeding 20 days,
in respect of loss of irrecoverable earnings and expenses arising
from service as a juror.
|

|
21. Oil and Water
We will pay for loss of:
- oil from a domestic heating
installation
- metered water
following accidental damage to the domestic water or heating
installation at the home up to a maximum amount of £1,000
each claim.
|
Loss of oil or water caused by gradual leakage or vaporisation.
|
22.
Title Deeds
We will pay for the cost of preparing new title deeds to the
buildings and their land, if they are lost or damaged by a
cause described in paragraphs 1 to 10 when in the home or in
a bank or safe deposit up to a maximum amount of £500 each claim.
|
|
|
23. Temporary Accommodation
If the home is made uninhabitable following a claim,
which we have accepted, for loss or damage by a cause described
in paragraphs 1 to 10, or where applicable paragraph 27, we
will pay the reasonable cost of comparable accommodation for you,
the family and your domestic pets for the period necessary
to restore the home to a habitable condition.
The maximum amount payable in aggregate is £7,500.

24.
Personal Accident
In the event of the death of you and/or your spouse
within 30 days of and as a direct result of injury caused in the home
by fire or thieves we will pay £5,000 to the legal personal
representatives of you or your spouse.
The maximum amount payable under this paragraph is £10,000.
|
|
25.
Lock replacement
If the keys to the locks of the external doors of the house, flat
or bungalow are lost or stolen, we will pay the cost of replacement
locks of an identical type operated by those keys up to a maximum
amount of £250 each claim.
The most we will pay under this paragraph and paragraph 13
of Section 1 is £250 in total each claim.

26. Occupier’s and Personal Liabilities
We will pay damages and claimants’ costs and expenses for
which you or a member of the family are legally liable
in respect of accidents occurring during the Period of Insurance
resulting in bodily injury or illness to any person or loss or damage
to property
The maximum amount payable in respect of each claim is:
- £10,000,000 for bodily injury or illness to any person domestically
employed by you or a member of the family
- otherwise £2,000,000.
In addition, we will pay defence costs and expenses incurred
with our written consent
In the event of your death we will indemnify your
legal personal representatives under the terms of this paragraph
in respect of liability incurred by you or a member of the
family

Liability
- for bodily injury or illness to a member of the family
- for damage to property belonging to or under the control of
a member of the family or a person employed by a member
of the family
- arising from a contract, whether written or not, which imposes
a liability which you or any member of the family
would not otherwise have been under
- arising out of any business or profession

- aircraft, hovercraft or watercraft (other than pedestrian
controlled models, pedestrian controlled toys or hand
or foot propelled boats not owned by you)
- mechanically powered vehicles

- animals of a dangerous species and livestock as defined
in the Animals Act, 1971, (other than horses used
for private hacking)
- any dog described in Section 1 of the Dangerous Dogs Act,
1991 or specified in the DangerousDogs (Northern Ireland)
order 1991 S.I. 2292 (N.I.21)
- arising out of ownership of the buildings and their land
or any other land or premises
- arising out of the occupation of land or premises other than
the buildings and their land at the Address of the Home
in the Schedule
- arising from the transmission of any communicable disease or
virus.

Accidental damage to the contents when in the home
|
The first amount of each claim shown alongside the word
EXCESS in the Schedule.
Damage caused by or resulting from:
- livestock, vermin, insects, mildew, the action of light or atmospheric
conditions, depreciation and deterioration from normal use
- wear and tear or any other gradually operating causechewing,
scratching, tearing or fouling by pets
- any process of cleaning, repair or alteration
- electrical or mechanical failure or breakdown.
Damage to clothing or contact lenses.
Damage arising while the home is unoccupied.
Damage caused by a person to whom the home or any part is
lent, let or sub-let.
Damage specifically excluded under paragraphs 1 to 9 and 11 to 14.

Section 5 - Personal Possessions
The sum insured stated in the Schedule
and Personal Possessions Specification is NOT index linked.
Basis of Claims Settlement
We
will pay the cost of repair incurred or where the article is lost or damaged
beyond repair the cost of replacement as new up to the amount stated in
the Personal Possessions Specification.
A deduction for wear and tear will be made in respect of clothing and pedal
cycles if lost or damaged beyond repair.
We have discretion following a claim to make payment in money
or effect necessary repair, replacement or reinstatement.
The maximum amount payable in respect of each item insured under this Section
is the limit stated in the Policy Schedule or the sum insured stated in
the Personal Possessions Specification if the item is specified.
We will not pay the cost of replacing any undamaged item or part of
any item solely because it forms part of a set, suite or one of a number
of items of a similar nature, colour or design.

Exclusions

1. We
will pay the professional costs and expenses of proceedings
incurred up to a maximum of £50,000 in order to:
|
|
|
(a) Pursue a claim in Great Britain, the Channel Islands, the
Isle of Man or Northern Ireland directly arising from one of the
following events or causes which occurs within these
areas and within the period of cover under this Section of the Policy:
- death or injury sustained by you from a sudden or specific
accident
- the purchase or hire of goods or services for
your private use including the purchase of
your permanent place of residence
- the
infringement of your legal rights relating to your
ownership or occupation of the home
- the breach of your contract of employment
- under sections 22 and 23 of the Data Protection Act 1984 for
financial loss only
- physical damage to your permanent place of residence.

Professional costs and expenses where:

- this involves a motor vehicle owned by you or for
which you are responsible
- illness or injury results from a gradually operating cause
- less than £100 is in dispute
- the agreement for the purchase or hire was made before cover
under this Section of the Policy began
- the event/cause occurs less than 180 days
after cover under this Section of the Policy
began
(iv) the breach occurs less than 90 days after cover
under this Section of the Policy began.

(b) Defend a claim in Great Britain, the Channel
Islands, the Isle of Man or Northern Ireland directly arising from
one of the following events or causes which occurs
within these areas and within the period of cover under this Section
of the Policy:
(i) a motoring prosecution brought against you
(Please in mitigation will only be
supported at our absolute discretion)
(ii) the sale of privately
owned goods by you.

- less than £100 is in dispute
- the agreement for sale was made before cover under this Section
of the Policy began.

2. Professional
costs and expenses incurred by you and arising from a detailed
examination by the Inland Revenue under its current system of investigation
into your personal and private tax affairs which occurs within
the Period of Insurance

- Professional costs and expenses which relate to a tax investigation
into any business trade or profession.
|
Exclusions which apply to Section 6
- The
first £50 of each claim.
- Appeals
unless:
- you
notify us in writing of your wish to appeal at least
six working days before the deadline for giving notice of appeal expires,
and
- we
consider the appeal to have a reasonable chance of success.
- Professional
costs and expenses incurred:
- before
we have written to confirm acceptance of a claim

higher than we have agreed
- where
we are not reasonably sure that the defendant has sufficient
assets to meet any judgement.
- Professional
costs and expenses, fines or other penalties which a court of criminal
jurisdiction orders you to pay.
- Claims
made or considered against us, or Eastgate Assistance, under
this Section of the Policy only.

Any incident involving a motor vehicle driven by you if you
do not hold (or are disqualified from holding or obtaining) a
driving licence at the time of the incident.

Any claim where the event or cause began before cover
under this Section of the Policy commenced.

Any professional costs and expenses that can be recovered
under another Section of the Policy or any other insurance.
-
Expert witness fees unless we have agreed in advance to the calling
of the witness and to the amount of the fees.
- Your
travelling expenses, subsistence allowance or compensation for absence
from work.
- Claims directly or indirectly caused
by, contributed to by or arising from:
- your business, trade, profession
(other than a claim under paragraphs 1(i), 1(iv) and 2(i))
- any venture for gain
- your deliberate or criminal act
or omission
- the construction or structural
alteration of your buildings or parts of them
- planning law including Town and
Country Planning
- subsidence, mining or quarrying
- patents, copyrights, trademarks,
merchandise marks, service marks, registered designs, intellectual
or artistic property, secrecy and confidentiality agreements and
passing off
- libel, slander or malicious falsehood
- divorce, judicial separation,
matrimonial matters, cohabitation, custody, access, maintenance
or proceedings including ancillary relief, custody, access, parental
responsibility, contact, cohabitation or affiliation
- actual, planned or proposed works
by or under the order of any government or public or local authority
- a lease or licence to occupy
land or property
- a dispute with a rating authority
on rateable values or taxation bands
- an application for a judicial
review
- computer software except operating
systems and packaged software that have not been tailored by the
supplier to your own requirements
- The Equal Pay Act 1970 and amending
legislation.
- Any further professional costs
and expenses if you withdraw instructions from the professional
adviser or the professional adviser refuses to continue acting
for you. You will become responsible for all professional
costs and expenses incurred both prior to and after such withdrawal,
unless at our absolute discretion we agree to the appointment
of another professional adviser.
- If you are unsuccessful in proceedings
you may not take any further legal action in the same case at our
expense without our prior written permission.
Conditions which apply to Section
6
- You must notify us
in writing as soon as reasonably possible but in any event within 180
days about any matter which could result in a claim being made under
this Section.
- If, after receiving a claim, or
at any time thereafter we decide that:
- your prospects of success
in proceedings are insufficient
- your interests would
be better served by another course of action
- we cannot agree to the
claim
we will write to you giving
our reasons. Subject to the rest of this condition, we
will not be bound to pay any professional costs and expenses
or any further professional costs and expenses for the claim.
If you are not satisfied with our decision, you
may ask us to get the opinion of a professional adviser
nominated by the Law Society about whether our view is sound
and reasonable. Both you and we are bound by that opinion.
If the professional adviser notifies us within one month that
our view is unsound or unreasonable, we will agree to
pay the professional costs and expenses of those proceedings.
We will also pay for that professional adviser’s opinion.
If the professional adviser thinks that our view is
sound and reasonable, you must pay for the professional
adviser’s opinion and may not begin proceedings in respect
of that claim at our expense.
-
At any time before proceedings are
issued
- we will appoint a professional
adviser to act for you and us
- we may take over the claim and
deal with it in your name.
If proceedings need to be
issued you may inform us of your choice of a
professional adviser. We may accept your choice if the
professional adviser confirms in writing that he or she will
co-operate with you so you can keep to the terms of
this Section. We must also agree the hourly rate or agreed
fees we will pay your professional adviser. The hourly
rate will depend upon how complicated the case is, the amount at stake
and where you live. If we cannot agree with your
choice of professional adviser, you may suggest another. If we
still cannot agree upon a suitable professional adviser, we
will ask the Law Society to choose a solicitor to act for you.
You and we must accept their decision.
If your professional adviser refuses to continue acting for
you for reasonable cause, or you discontinue his or
her instructions then our liability will stop at once unless
we agree to the appointment of another professional adviser.
-
If another person is ordered, or
agrees, to pay you all or any costs and expenses, either
in full or by instalments, you will do everything possible
(subject to our directions) to recover the money and
hold it on our behalf. If payment is made by instalments these
will be paid to us until we have recovered the total
amount that another person was ordered, or agreed to pay by way of
costs.

We will not be bound by
any promise or undertaking given by you to the professional
adviser.
-
You will send us
all bills for professional costs and expenses immediately on
receiving them.
-
If we request it, you
must request the professional adviser to send his bill to be
examined or certified by the Law Society or any other appropriate
body.
-
If you die, we will
insure your legal personal representatives to pursue claims
on your behalf covered by this Section of the Policy arising from
your death provided they keep to the terms of the Policy.
-
You must:
- give proper instructions in due
time
- provide information at your
expense
- not do anything to prejudice
your case, or our position.
- If there is a dispute under this
Section between you and us for which provision is not
otherwise made, such dispute must be referred by you to the arbitration
of a single arbitrator who shall be either a solicitor or a barrister
nominated by the parties or, failing agreement, nominated by the Law
Society. Such arbitration shall be in accordance with the provisions
of the Arbitration Acts then in force and shall be binding on the parties.
- If the claim is accepted we
will write to confirm this. We will not pay any professional
costs and expenses incurred before we have confirmed acceptance
of a claim in writing, nor any professional costs and expenses
unless we have approved them in advance.
- You must co-operate fully
with us in all respects. You must keep us fully
informed of all important developments in your case.
- You or the professional
adviser must notify us prior to accepting or rejecting any offer
or payment into court with a view to a settlement. If you do
not accept this offer for payment and we consider that the outcome
of the case will be equally or less favourable to you than the
offer or payment we shall only be liable for any further professional
costs and expenses after the offer or payment was made, if
we have given our authority for the case to continue.
- Our liability to make any
payment under this Section of the Policy will be conditional upon compliance
with its terms and conditions.
Claims Procedure under Section 6
- To make a claim, please call Eastgate
Assistance on 08705 234-500 giving details of the problem. You
will then be sent a Legal Expenses Claim form for completion.
- The claim form should be returned
to Eastgate Assistance, Eastgate House, Stephenson Road, The Business
Park, Colchester, Essex CO4 4QR giving:
- a full and truthful report of the
facts
- names of any possible witnesses
- any written or other evidence.
- We may investigate the case
and, subject to your final approval (which will not be unreasonably
withheld), try to settle it.
- You will instruct the professional
adviser to send us immediately any relevant documents, information
or advice. You will give the professional adviser any
other instructions that the professional adviser or we
may require.
- All letters to us must be
sent to the address in Paragraph 2. Our letters will be sent
to the address shown in our records or, if we accept the
claim, to the address of the professional adviser.
Section 7 – Caravan
Definitions for the purposes of Section
7 Only
The definitions shown alongside the
following words or expressions will apply wherever they appear in Section
7 of the Policy.

The private trailer caravan
described in the Schedule together with its fixtures, fittings and
awnings.

| Europe |
The British Isles,
any other member country of the European Union, Czech Republic, Slovakia,
Hungary, Iceland, Leichtenstein, Norway, and Switzerland.
|
| market value |
The cost of replacing the
insured caravan with one of similar age, type and condition.
|
Basis of Claims Settlement
We
will pay the cost incurred in repairing or replacing the caravan
or make a cash settlement which does not exceed the market value
of the caravan at the time of the loss or damage.
If, within one year of purchase as new in your name, your caravan
is:
- stolen and not recovered
or
- damaged to an extent greater than
60% of the manufacturer’s list price (including Value Added Tax)
at the time of the loss or damage
we will, replace the caravan
with a new caravan of the same manufacture and model if available, or
the nearest equivalent, or at our discretion pay cash equivalent
to the manufacturer’s last list price (including Value Added Tax)
at the time of loss or damage provided that the maximum amount payable
by us does not exceed:
(i) the original purchase price as new of the lost or damaged
caravan
or
(ii) the value of the lost or damaged caravan as last advised
to us
whichever is the less.
Following settlement on this basis the caravan will then belong
to us.
We will not pay a greater sum than the maker’s last list price
in the United Kingdom for the supply of any spare part (together
with a reasonable charge for fitting).
The maximum amount payable for each claim is the sum insured stated
in the Schedule plus reasonable removal and delivery costs less any amount
stated in the Exclusions.
We will pay the cost incurred in repairing or replacing furniture,
furnishings, utensils and household linen, or where the item is lost or
damaged beyond repair, the cost of replacement as new (or, if unavailable,
its nearest equivalent). A deduction for wear and tear will be made
in respect of household linen lost or damaged beyond repair.

1. The caravan and its furniture, furnishings, utensils
and household linen whilst in, on or in the immediate vicinity of
the caravan are insured against:
Loss or accidental damage:
- whilst in the British Isles or
- whilst being used for holiday purposes elsewhere in
- Europe for no more than 60 days in any one Period of
Insurance
- whilst in transit by land, air or sea within Europe.
In addition, following loss or damage we will pay the reasonable
cost of:
- removal to the nearest competent repairer, and
- delivery to you when the repairs have been completed.

Loss of use, loss or damage arising from confiscation, detention
or seizure, depreciation, deterioration from normal use or wear

left unattended unless it is securely locked and secured by a
wheel clamp or similar security device designed to prevent its
removal
- caused by storm or flood during the months of October to March
inclusive while the caravan is left unoccupied on a holiday
caravan site
- arising while the caravan is used as a permanent dwelling,
let for hire or reward or used other than for holiday purposes
- caused by any wilful or malicious act by any occupant or user
of the caravan.

2. If the caravan is in use for touring or holiday purposes
and the caravan is made uninhabitable following a claim
which we have accepted under paragraph 1 we will pay
£15 per day up to a maximum of £300 towards the cost of alternative
accommodation
|
|
3.
We will pay damages and claimants’ costs and expenses for which
you or your family are legally liable in respect of
accidents occurring during the Period of Insurance resulting in bodily
injury or illness to any person or loss or damage to property arising
from the ownership or use of the caravan
The total amount payable in respect of each claim is limited
to £1,000,000
In addition, we will pay defence costs and expenses incurred
with our written consent
We will also provide cover for any person using the caravan
with your consent
In the event of the death of any person insured under this Section
we will indemnify their personal legal representatives in respect
of the liability

- For damage to property belonging to or under the control of
any person insured under this Section
- Arising out of the ownership or use of the caravan for
any business or profession
- Caused by or arising from the caravan being towed or
attached to a towing vehicle
- Arising from a contract, whether written or not, which imposes
a liability which you or any person insured would not otherwise
have been under
- Arising while the caravan is let for hire or reward or
used other than for holiday purposes
- Arising out of the ownership or use of the caravan as
a permanent dwelling.

General Exclusions which apply to the whole
policy
- Reduction in value following repair
or replacement.
- Any consequence of war, invasion,
act of foreign enemy, hostilities (whether war be declared or not),
civil war, rebellion, revolution, insurrection or military or usurped
power.
- Loss or damage to property or any
expense, consequential loss or legal liability (other than liability
to your domestic employees) directly or indirectly caused by or
contributed to by:
- Ionising radiations or contamination
by radioactivity from any nuclear fuel or from any nuclear waste
from the combusion of nuclear fuel
- The radioactive, toxic, explosive
or other hazardous properties of any explosive nuclear assembly
or its nuclear component.
- Loss or damage by pressure waves
caused by aircraft and other aerial devices travelling at sonic or supersonic
speeds.
- Loss or damage to property or any
legal liability directly or indirectly caused by or contributed to by
or arising form pollution or contamination where such pollution or contamination:
- Occurred outside a Period of
Insurance provided by this policy, or
- Was the result of a deliberate
act, or
- Was expected and not the result
of a sudden, unforeseen and identifiable incident.
- Loss or damage or any expense, consequential
loss or legal liability (other than liability to your domestic employees)
directly or indirectly caused by or contributed to by or arising from:
- The failure of the programming
of a computer chip or computer software to recognise the Year 2000
or any other year or to function correctly according to a true calendar
date
- computer viruses
But this shall not exclude subsequent
loss or damage or any expense, consequential loss or legal liability
not otherwise excluded which itself results from the operation of
an insured cause.
Conditions which apply to the whole policy
1. Our
liability
- shall not exceed its rateable proportion
if any other insurance covers loss, damage or liability insured under
this Policy
- shall be limited to the excess value
beyond the amount of any more specific insurance up to the sums insured
or limits stated in the Policy, Schedule and Specifications.
2. We may cancel the
Policy, or any section of the Policy, by sending 7 days’ notice by letter
to your last known address in which event we will refund
the unexpired portion of the premium. You may cancel this Policy
at any time by giving us 7 days’ notice by letter. Provided that
no claim has occurred during the current Period of Insurance you
will be entitled to a return of the unexpired portion of the premium.
Where the cover provided by Section 2 is cancelled mid-term by you,
a pro rata premium refund will only be allowed providing Section 1 is
also cancelled.
3. On the happening of any event likely to give rise to a claim
under the Policy, you must:
a. advise us in writing
as soon as reasonably possible
b. advise the police as soon as possible if the loss or damage
appears to have been caused by theft, malicious acts, riot or civil
commotion
c. not admit liability
d. forward to us unanswered and without delay all correspondence
and legal documents (for example, solicitor’s letter or claim form)
you receive
e. co-operate with us and not abandon any property to
us
f. provide us, at your expense, with all information
and evidence as may be reasonably required.
4. We are entitled at
our own expense to take proceedings in your name to recover
any payment made under this Policy when we consider that there
are rights of recovery against other parties and you must assist
when reasonably required to do so. We are also entitled to conduct
the defence or settlement of any claim and to instruct a solicitor
to act for you in any civil or criminal proceedings arising from
any event likely to give rise to a claim under the Policy, other
than a claim under Section 6 of this Policy for which special arrangements
apply.
5. If you make a claim under the Policy knowing the
claim to be false or fraudulent in any respect, the Policy shall
become void, and all claims under it shall be forfeited. You
will not be entitled to a return of the unexpired portion of the premium.
6. You and members of the family will take all reasonable
steps to safeguard against loss, damage, accident or injury.
7. If this Policy is issued or renewed on the basis of monthly
premiums, our liability will cease in the event of non-payment
of any monthly premium on its due date but before cancellation takes effect
we will send 7 days’ notice by letter to your last known
address.
8. In the event of a claim being accepted by us under
Section 1 Buildings, Section 4 Contents and Section 5 Personal Possessions
in respect of loss or damage occurring at the same time and by the same
cause, the amount deducted from the total cost of the claim will
be limited to the greater of the amounts shown against the word EXCESS
for Buildings or Contents in the Schedule.
9. This contract is to be governed solely in accordance with the
relevant laws of the United Kingdom, Channel Islands or Isle of Man. If
there is any dispute as to which law applies it shall be English law.
10. A person or company who is not a party to this policy has no
right under the Contracts (Rights of Third Parties) Act 1999 to enforce
any term of this policy but this does not affect any right or remedy of
a third party which exists or is available apart from that Act.
Endorsements
These endorsements and any supplementary
endorsements are operative only if the number set against them appears
under ‘Endorsements’ in the Schedule.
All endorsements are subject to the exclusions and conditions of the Policy.
- Other Interest
We note the interest in the insurance under Section 1 Buildings
of the party whose name appears alongside this endorsement number in
the Schedule.

- Intruder Alarm Protection
Loss or damage occurring in the home resulting from theft or
attempted theft is excluded under Section 4 Contents and Section 5 Personal
Possessions unless the intruder alarm system required by us is:
- installed in accordance with
the specification agreed by us and no alteration or variation made
without our written consent
- kept so far as is reasonably
possible in full and efficient working order at all times and serviced
under a maintenance contract approved by us
- tested and set whenever you
and the family have retired for the night and whenever the
home is left unattended.
- Property in Safe
The insurance in respect of items listed in the Personal Possessions
Specification and identified by similar number alongside this endorsement
number in the Schedule excludes theft unless the Items are in use or
when not in use contained in a locked safe in the home.
- Not applicable to this Policy.
- Rent and Accommodation Expenses
– Buildings
The maximum amount payable under paragraph 14 of Section 1 Buildings
is increased to the percentage shown alongside this endorsement number
on the Schedule.
- Personal Possessions
In respect of items listed in the Personal Possessions Specification
and identified by similar number alongside this endorsement number in
the Schedule, Section 5 Personal Possessions is extended during the
Period of Insurance to include cover outside the British Isles
for more than 60 days.
- Property in a Bank
The insurance in respect of items listed in the Personal Possessions
Specification and identified by similar number alongside this endorsement
number in the Schedule shall apply only while the items are in a bank
or safe deposit.
- Trade Premises
The home forms part of a building otherwise occupied in accordance
with the description shown alongside this endorsement number in the
Schedule.
- Contents - Index Linking
The sum insured under Section 4 Contents is index linked. As
a consequence the following changes are made to the policy wording:
- The definition of index linked
is extended to include:
Contents - the sum insured stated in the Schedule will be
adjusted monthly in line with the Durable Goods Section of the General
Index of Retail Prices or its equivalent.
At each renewal the premium will be calculated on the adjusted sum
insured.
- The fourth paragraph of the Basis
of Claims Settlement is deleted and replaced with:
The maximum amount payable for each claim under paragraphs
1 to 10, 13 and 16, and where applicable paragraph 27, of this Section
is the Contents sum insured stated in the Schedule less any amount
stated in the exclusions. The sum insured will not be reduced by
the amount of any claim payment.

send it to us with any estimates, accounts and supporting documentation.

booklet which is supplied to you separately. If you do not receive it,
please inform us or your insurance adviser.
Claims and Underwriting Exchange
Insurers and their agents share information
with each other to prevent fraudulent claims and to assess whether to
offer insurance including the terms via the Claims and Underwriting Exchange
register, operated by Insurance Database Services Ltd. A list of participants
is available on request. In the event of a claim, the information you
have supplied on your application form, together with the information
you supply on a claim form and other information relating to the claim,
will be put on the register and made available to participants.
It is a condition of taking out or renewing your policy with us that you
give your consent to the information on your application form and on any
claims you make being supplied to IDS Ltd so that it can be put on the
register and made available to other insurers. It is also a condition
that you agree in response to any searches we may make in connection with
any claims you have made in the past or may make in the future that IDS
Ltd may supply information it has received from other insurers about other
claims you have made.
Complaints Procedure
At Zurich Insurance we pride ourselves
on the service we provide to our customers. However, if you feel you have
cause for complaint regarding your Policy, you should, in the first instance,
contact either the intermediary who arranged the Policy for you or our
Service Centre Manager at the address shown on your Policy Schedule. Should
your complaint concern a claim, please contact the Property Claims Manager
at the address shown on page 39.
Please provide details of your Policy and in particular the Policy number,
to help us deal with your complaint.
If you are still not satisfied with the way in which your complaint has
been dealt with, please write to the Chief Executive at the Company’s
Head Office at the address shown on your Policy Schedule.
In the unlikely event that we are unable to resolve any dispute between
us you may ask the Insurance Ombudsman Bureau (IOB)
to review your case, the address of which is as follows:
