At renewal the premium will be based on the adjusted sums, and for your protection should the index fall below zero we will not reduce the sums recorded on your schedule. Claims Settlement Under Part 1 If the contents are stolen or damaged as a result of any of the causes insured under this policy 1. We will at our option a) replace as new or b) pay the cost to us of replacing as new or c) repair or d) pay the cost to us of repairing any item of contents (except for clothing more than 2 years old) 2. We will make a deduction for wear and tear from the cost to us of replacement or repair of clothing more than 2 years old 3. The maximum amount we will pay in respect of any one claim a) for contents is the sum recorded on your schedule b) for high risk property is i) in total, the sum recorded against the high risk limit on your schedule ii) for any single article the sum recorded against the high risk limit per item on your schedule iii) for business equipment is 10% of the contents sum recorded on your schedule c) for Alternative Accommodation is 20% of the contents sum recorded on your schedule. Rent and other costs and expenses which you would have paid but for the damage will be deducted from any payment made d) for your Liability as Tenant is 10% of the contents sum recorded on your schedule e) for Contents Temporarily Removed from your home is 15% of the contents sum recorded on your schedule f) for contents in any garage and domestic outbuilding is 5% of the contents sum recorded on your schedule g) for external satellite broadcast receiving equipment is 5% of the contents sum recorded on your schedule. The sum recorded on your schedule will not be reduced following payment of a claim provided that all damage is made good without delay and any reasonable recommendations we make to prevent further loss or damage are carried out without delay.

Claims Settlement Under Part 2
The maximum amount we will pay is £2,000,000 in respect of any one claim or number of claims arising out of any one accident. We will also pay all legal costs and expenses which you have to pay provided they are incurred with our written consent. If the accident involves injury (including disease and illness) to a person working for you under a contract of service or apprenticeship and the injury arises out of and in the course of such service or apprenticeship
a) the maximum amount we will pay is £5,000,000 in respect of any one claim or number of claims arising out of any one accident. b) the maximum amount we will pay is inclusive of claimants costs and expenses and all other costs and expenses incurred with our written consent. If you die we will indemnify your personal representatives against liability incurred by you and insured by this policy. |

Claims Settlement Under Part 1 If the caravan suffers loss or damage insured under this policy 1. We will at our option pay either a) the cost of repairing the caravan or b) if the cost of repair exceeds the market value i) the market value if the caravan is more than 12 months old or ii) the cost of replacement as new if the caravan is less than 12 months old 2. We will at our option a) replace as new or b) pay the cost of replacing as new or c) pay the cost of repairing any item of furniture, furnishings, fixtures, fittings, household linen and utensils in the caravan 3. General Exceptions to Section 6 Claims directly or indirectly caused by, contributed to by or arising from a) your business, trade, profession or any venture for gain unless the claim relates to a breach of your contract of employment b) a deliberately criminal, false or fraudulent act or omission by the insured c) the planning or the construction or structural alteration of buildings or parts of them d) subsidence, heave or landslip, mining or quarrying e) patents, copyrights, trademarks, merchandise marks, registered designs, intellectual or artistic property, secrecy and confidentiality agreements f) libel or slander g) divorce, matrimonial matters, cohabitation, custody, access, maintenance or affiliation h) any works by or under the order of any government or public or local authority i) a dispute between landlord and a tenant j) a dispute with a rating authority on rateable values Any legal costs and expenses that can be recovered (or would be recoverable save for an act or omission by you which invalidates the insurance) under another section of this policy or any other insurance Expert witness fees unless we have agreed in advance to the calling of the witness and to the amount of the fees Your travelling expenses, subsistence allowance or compensation for absence from work Any further legal costs and expenses if you withdraw instructions from the solicitor or you withdraw from the legal proceedings Any claim arising under the Equal Pay Act 1970 and amending legislation |

Claims Settlement Under Section 6 1. The maximum amount we will pay for any claim or claims arising from one event or cause or series of events or causes linked by cause or time is the limit shown on the schedule. 2. To make a claim use the Legal Helpline and request a claim form, complete this fully, provide any other information requested and return promptly to Capita Assistance, Eastgate House, Stephenson Road, The Business Park, Colchester CO4 4QR. 3. You must provide us with all information we reasonably require in order to prove your claim. If your claim is accepted we will refund your reasonable costs. 4. If the claim is accepted we will write to confirm this and to provide the name and address of a solicitor whom we suggest should act for you. We will not pay any legal costs and/or expenses incurred before we have confirmed acceptance of a claim in writing, nor any legal costs unless we approve them. 5. We may investigate the case and, subject to your final approval (which you must not unreasonably withhold) try to settle it. 6. You must co-operate fully with us in all respects. You must keep us fully informed of all important developments. 7. We will have direct access to the solicitor at all times. You will instruct the solicitor to send to us as soon as reasonably possible any relevant documents, information or advice. You will give the solicitor any other instructions that he or we may reasonably require. 8. You or the solicitor will notify us as soon as reasonably possible in writing of the making of any offer or payment into court with a view to settlement. If you do not accept this offer or payment and we reasonably consider that the outcome of the case will be equally or less favourable to you than the offer or payment we shall only be liable for any further legal costs and expenses after the offer or payment was made if we have given our authority for the case to continue. If you are not satisfied with our decision the dispute must be resolved in accordance with Condition 9 of the Conditions Relating to this Section. 9. If you are unsuccessful in legal proceedings you may not take further legal action in the same case at our expense without our prior written permission. |

Conditions Relating to Section 6 only 1. You must notify us in writing as soon as reasonably possible but in any event within 180 days about any matter which could result in a claim being made under this section. 2. If after receiving a claim, or at any time thereafter we decide that - your prospects of success in legal proceedings are insufficient - we cannot agree to the claim we will write to you giving our reasons. Subject to the rest of this condition we will not be bound to pay any legal costs and expenses or any further legal costs and expenses for the claim. If you are not satisfied with our decision the dispute must be resolved in accordance with Condition 9. 3. If another person is ordered or agrees to pay you all or any legal costs and expenses, charges or compensation either in full or by instalments you will do everything possible (subject to our directions) to recover the money and hold it on our behalf. If payment is made by instalments these will be paid to us until we have recovered the total amount that the other person was ordered or agreed to pay by way of costs. 4. We will not be bound by any promise or undertaking given by you to the solicitor. 5. You will send us all bills for legal costs and expenses as soon as reasonably possible on receiving them. 6. If we request it you must request the solicitor to send the bill to be examined or certified by the Law Society or any other appropriate body. 7. We may cancel this part of the insurance by giving 7 days notice in writing to your last known address. A proportionate refund of premium will be made. You may cancel this part of the insurance by giving 7 days notice in writing to us. No refund of premium will be made. 8. If there is a dispute under this section between you and us either you or we may refer it to the arbitration of a single arbitrator who will be either a solicitor or barrister to be agreed between the two sides. If they are unable to agree the President of the Law Society shall name an arbitrator. The arbitrator’s decision will be final and binding on both sides. The arbitration will be governed by the rules set out in the Arbitration Acts then in force. The costs of arbitration will be at the discretion of the arbitrator. 9. If at anytime we consider that your prospects of success in the legal proceedings are insufficient or that your interests can be better achieved by other means we will provide you with a written explanation for our decision. If you disagree with this you have the right to request us to obtain an opinion from an independent solicitor or barrister. If we are unable to agree on a suitable solicitor or barrister the President of the Law Society will be asked to provide a nomination. If the independent opinion disagrees with our view we will pay the costs of obtaining it. If the independent opinion supports our view you must bear the costs of obtaining it. |

10. You may notify us of the solicitor you wish to act for you. We have the right to refuse your nomination. If we are unable to agree on a suitable solution to the matter we will ask the Law Society to nominate a solicitor to act on your behalf. We and you must accept the Law Society’s nomination. In the meantime we may appoint a solicitor to act on your behalf to safeguard your interests. 11. If you die we shall insure your legal personal representatives to pursue claims covered by this section of the policy arising from that death provided they keep to the terms of the policy. 12. You must - give proper instructions to your solicitor and to us - not do anything to prejudice your case. 13. Our liability to make any payment under the policy will be conditional upon the compliance with its terms and conditions. 14. If any legal costs and expenses arising under this section are also covered or covered in part by any other insurance we will be liable only for our rateable proportion of such legal costs and expenses. 15. Where reference is made to the payment of premium such reference includes your having agreed to pay under an instalment plan. If we have agreed to accept the first premium or any subsequent premium by instalment the policy remains an annual contract and if any premium instalment is not received on or before its due date then all unpaid premium instalments and credit charge become immediately due. Should the full premium and credit charge not be paid within 10 days of our giving written notice of non-payment the policy will be cancelled immediately upon expiry of such notice. Following such cancellation we will unless a claim has already been made during the current period of insurance refund any balance of premium paid after deduction of an appropriate charge for the insurance provided to the date of cancellation. |

General Conditions Applying to Sections 1-5 of this Policy 1. Fraud All benefit under this policy will be forfeited if any claim made is in any respect fraudulent or if any fraudulent means or device is used by you or anyone acting on your behalf to obtain payment under this policy. 2. Compliance with terms Our liability to make payment under the policy will be conditional upon the compliance with the terms and conditions of this policy. 3. Your duty to prevent loss or damage You must take all reasonable steps to safeguard any buildings, contents or property against loss or damage and to prevent accidents. In the event of loss or damage occurring you must take all reasonable steps to prevent further loss or damage to your property. 4. Changes in risk You must give us written notice as soon as reasonably possible of any change in circumstances which may increase the possibility of loss, damage or injury. (Examples of such circumstances are contained on page 2 of this policy booklet. These examples are an indication and are not exhaustive.) 5. Your obligations following a claim In the event of a claim or possible claim under this policy you must not negotiate, admit liability or make any offer or promise or payment without our written consent Additionally you must i) inform the police as soon as is reasonably possible of any riot, damage, theft or loss of property ii) notify us as soon as reasonably possible giving full particulars of the occurrence. iii) give us written notice as soon as possible (but no later than 7 days) after you have knowledge of any pending prosecution, inquest or fatal inquiry in connection with any occurrence for which there may be liability under this policy. iv) send us, as soon as reasonably possible, every relevant letter, claim, writ, summons or process. We will refund your reasonable costs v) as soon as reasonably possible after the injury, loss or damage deliver a written claim to us with such detailed particulars and proofs certificates or other documents as we may reasonably require. In the event of the claim being met under the terms of this policy we will refund your reasonable costs. vi) give all such information and assistance as we may reasonably require. |
